Two publication rules apply to any filing: a provisional is not published unless you later reference it in a filed utility application, and a standard U.S. utility application publishes automatically 18 months after the earliest priority date unless a nonpublication request is filed. Publicly disclosing or selling your invention before filing can also affect your rights in many countries, so filing first is usually the safer sequence.
